These Terms of Use (“Terms”) govern access to and use of the TruckFix marketplace at https://truckfix.net, including account creation and sign-in, and public pages that link to these Terms (the “Service”). The Service is provided by TruckFix. Read these Terms with the Privacy Policy and Cookie Policy.

The Service is intended for adults and businesses seeking commercial-vehicle services in the United States. Access from another country does not change the intended US market.

Viewing or using the current free public Service is subject to these Terms to the extent permitted by applicable law. When the account-entry screen says that continuing means agreeing to these Terms, submitting an email address or choosing Google or Apple to continue indicates that agreement. The Service does not currently store a separate Terms-version assent record against the account. A later booking, payment, arbitration agreement or other material obligation will require a separate conspicuous notice and any affirmative acceptance required by law. Merely viewing another public page is not substituted for affirmative acceptance where the law requires it.

Nothing in these Terms excludes a right or remedy that applicable law does not allow TruckFix to exclude. More specific terms control for a later TruckFix feature or separately agreed service if they conflict with these Terms.

2. What the current Service does

The current public Service lets visitors:

  • search for truck and trailer service providers by location, service, date, time and filters;
  • view public shop information, images, service menus, availability, aggregate ratings and review details;
  • request a passwordless email link, or use Google or Apple, to create or access an eligible account;
  • complete a self-service Driver or Fleet Owner profile, or access an eligible existing fleet-provisioned Driver or Manager account, including any Fleet Admin status assigned to it;
  • use address suggestions, device location and interactive maps where available; and
  • use displayed contact information to communicate directly with a shop outside the Service.

The current public Service does not accept or confirm a booking, payment or review submission. A displayed service/date/time selection is a search or availability draft only. No appointment or repair contract is formed by selecting a draft or viewing an available time.

Sponsored shops have a paid TruckFix subscription that can give them priority among otherwise matching results. They are identified with a clear Sponsored label in the results. Sponsorship does not change the matching requirements a shop must satisfy for the relevant result group.

3. TruckFix's role and independent shops

TruckFix operates a search and information platform. Unless a later booking or checkout flow expressly states otherwise, TruckFix:

  • does not own, operate, employ or control listed repair, towing or tire providers or their personnel;
  • does not inspect, perform, supervise or warrant their work;
  • is not the merchant of record or a party to a contract made directly between a visitor and a shop; and
  • does not set a shop's price, warranty, cancellation rule, service area or professional qualification.

Shops are independent businesses responsible for their services, statements, licenses, insurance, prices, estimates, work, safety and legal compliance. Visitors decide whether a shop and proposed service are suitable and should confirm material information directly with the shop before traveling, authorizing work or incurring cost.

4. No emergency or safety-critical service

The Service is not an emergency-dispatch, roadside-safety, law-enforcement or medical service. Do not rely on search results, maps, availability or response times where delay may endanger a person, vehicle, cargo or property. In immediate danger, move to a safe location where possible and contact the appropriate emergency authority or qualified roadside provider.

Map locations, distances, routes, opening status, availability and time estimates can be incomplete, delayed or inaccurate. Follow road signs, traffic rules, vehicle restrictions and professional judgment. Do not interact with the Service while driving.

5. Eligibility

The Service is intended for people aged 18 or older and is not directed to children. The current public Service has no age-verification flow. Consumers as well as business users may use the Service; mandatory consumer protections remain in effect.

Accounts and sign-in

The Service uses passwordless sign-in. TruckFix can send a one-time link to the email address the user enters, or the user can continue through Google or Apple. Opening a live, unused link verifies control of that address for the sign-in. TruckFix does not ask the user to create a Service password. Access to the email address or provider account used for sign-in can therefore permit access to the TruckFix account; users must protect that access and promptly report suspected misuse.

A new self-service public profile asks for first name, last name, telephone number and whether the account is a Driver or Fleet Owner. A Fleet Owner also provides the fleet name and a selected fleet address. Separately, the connected TruckFix fleet tool creates a Driver account when a Fleet Owner or Fleet Manager provisions one, or a Manager account when a Fleet Owner or Fleet Admin provisions one; only a Fleet Owner may grant or remove Fleet Admin status. A provisioned account exists before that person's first sign-in. That tool may give an additional notice. Users must provide accurate current information, must not claim a role or authority they do not have, and may use only the fleet and account functions their role permits.

An account is for the person and authorized business relationship for which it was issued. Users may not share a sign-in link, session or provider authorization, bypass role restrictions, or use another person's account. TruckFix may refuse, restrict or suspend account access where reasonably necessary to investigate misuse, protect the Service or comply with law, subject to non-waivable rights.

Signing out ends the current browser session; it does not delete the account. Available deletion or fleet-removal controls depend on the user's role, how the account was created, active service records and applicable law. A user may contact TruckFix through Section 20 or the rights route in the Privacy Policy to request review of account access, correction or deletion.

6. Permission to use the Service

Subject to these Terms, TruckFix grants a limited, personal, revocable, non-exclusive and non-transferable permission to access and use the public Service for its intended purpose. This does not transfer ownership of the Service or its content.

Visitors may use ordinary browser functions, share a public link and print a reasonable copy for personal or internal business use. Commercial republication, resale, framing or creation of a substitute directory requires written permission.

7. Acceptable use

You must not:

  • break the law, infringe another person's rights or use the Service for fraud, harassment or harm;
  • interfere with security, access controls, availability, rate limits or normal operation;
  • probe, scan, introduce malware, send abusive traffic or attempt unauthorized access;
  • use automated means to scrape or systematically extract shop, review, map or other content except under a written license or where non-waivable law permits;
  • misrepresent identity, authority, location, vehicle, need or affiliation;
  • use shop or reviewer information for unsolicited marketing, profiling or harassment;
  • remove ownership, attribution, trademark or legal notices;
  • reverse engineer or derive source code except where applicable law expressly permits it; or
  • help another person do any of the above.

TruckFix may use proportionate technical measures, suspend access or contact authorities where reasonably necessary to protect the Service, visitors, shops or others, subject to mandatory law.

8. Shop information, reviews and other content

TruckFix marketplace and ERP systems supply public shop records maintained by shops, authorized operators and TruckFix administrators. Review records originate through TruckFix products. TruckFix aims to present records accurately but does not guarantee that every address, number, service, image, review, rating, hour, price or availability statement is complete, current or error-free.

A review reflects its author's experience and opinion, not a TruckFix certification. Aggregate ratings summarize received ratings. TruckFix does not independently verify every review. Report inaccurate, unlawful, fraudulent, privacy-invasive, abusive or rights-infringing content to support@truckfix.net. TruckFix may remove or restrict reported content after a proportionate review and may request enough information to evaluate the report.

TruckFix does not claim a registered Digital Millennium Copyright Act safe-harbor agent for the current Service. A copyright owner or authorized representative may report allegedly infringing content to support@truckfix.net and should identify the protected work, the reported material and its location, contact details, a good-faith statement, an accuracy and authority statement, and a physical or electronic signature. TruckFix reviews and responds to reports under applicable law without representing that this ordinary reporting route is a registered safe-harbor process.

9. Location and map features

A visitor can type a location instead of giving browser geolocation permission. Browser or operating system settings control device-location permission. Visitors are responsible for checking the selected location before relying on a search.

The Service uses Google Places, Google Geocoding and, after the relevant privacy choice, Google Maps. Use of Google Maps features and content is subject to the Google Maps/Google Earth Additional Terms and Google Privacy Policy, as well as map attribution. Do not remove or obscure attribution.

A shop telephone number, website, map, image or other third-party destination can lead to a service TruckFix does not control. A visitor's communication or transaction with that third party is between them and is subject to the third party's own terms, prices, privacy notice and security practices.

A link, listing or integration does not by itself mean TruckFix endorses, guarantees or is legally responsible for the third party. This does not limit responsibility that applicable law places on TruckFix or an express statement about a specific relationship.

11. Intellectual property

The Service's software, design, compilation, text, graphics, branding and TruckFix-provided materials are owned by TruckFix or its licensors and protected by applicable law. TruckFix names, logos and marks may not be used in a confusing or endorsement-implying way without written permission.

Shop names, logos, images, reviews, Google Maps content and other third-party material belong to their respective owners and can carry additional restrictions. No license is granted except the limited right to view them through the Service as intended.

Voluntary feedback about the public Service may be used by TruckFix without restriction or payment, provided TruckFix does not publicly identify the source without permission. Personal information is handled under the Privacy Policy.

12. Privacy

The Privacy Policy explains how TruckFix handles personal information. The Cookie Policy explains cookies, local storage, Google Maps browser connections and choices. Agreement to these Terms is not consent to an optional privacy category; optional features remain off until the relevant choice is granted.

13. Availability and changes

TruckFix may maintain, secure, repair, update or discontinue part of the free public Service. TruckFix does not promise continuous, uninterrupted or error-free availability. Maintenance, provider failure, network conditions, abuse, security events and events outside reasonable control can affect it.

Where applicable law or a paid/additional agreement requires advance notice, continuity, refund or another remedy, that requirement controls.

14. Disclaimers

To the maximum extent permitted by applicable law, the public Service and its content are provided “as is” and “as available.” TruckFix disclaims implied warranties of merchantability, fitness for a particular purpose, title and non-infringement, and does not warrant that a listed shop, service, availability, review, map, distance, route or third-party information is accurate or suitable.

These disclaimers do not apply to an express written warranty or a right applicable law does not allow TruckFix to exclude. They do not disclaim a shop's independent obligations for agreed work.

15. Limitation of liability

To the maximum extent applicable law permits, TruckFix and its personnel will not be liable for an indirect, incidental, special, exemplary, punitive or consequential loss, or for lost profit, revenue, opportunity, data or goodwill, arising from the public Service or a third-party shop where the loss was not reasonably foreseeable or is lawfully excludable.

Subject to non-excludable matters, TruckFix's aggregate liability arising from the public Service will not exceed the greater of USD 100 or the amount paid directly to TruckFix for the public Service in the preceding 12 months.

Nothing in these Terms limits liability for fraud or fraudulent misrepresentation, willful or deliberate misconduct, death or personal injury caused by negligence, violation of mandatory consumer rights, or another liability applicable law does not permit to be limited or excluded. State-law limits apply only to the extent allowed.

16. Business-user indemnity

If you use the Service for a business, you will defend and indemnify TruckFix against a third-party claim, damage and reasonable cost arising from your unlawful misuse of the Service, infringement of another person's rights, or material breach of Section 7. This does not cover a claim caused by TruckFix and does not apply to a consumer where prohibited by law.

17. Governing law and disputes

Illinois law governs these Terms, without regard to conflict-of-law rules, except where mandatory federal law or the law of a consumer's state provides a non-waivable protection. Subject to such protections, state and federal courts located in Cook County, Illinois have exclusive jurisdiction.

Before formal proceedings, you and TruckFix may try in good faith to resolve a dispute by emailing support@truckfix.net, unless urgent relief or applicable law makes that inappropriate. These Terms contain no mandatory arbitration agreement and no class-action waiver.

18. Changes to these Terms

TruckFix may update these Terms for a change in the Service, law, security or business. The updated version will state its effective date. A material change receives any advance notice and affirmative agreement required by law and is not quietly applied retroactively. Continued use after a lawful effective date constitutes acceptance only to the extent applicable law permits.

19. General terms

If a provision is unenforceable, it will be enforced to the maximum lawful extent or removed while the rest remains effective. A failure to enforce once is not a waiver. You may not assign these Terms without TruckFix's consent; TruckFix may assign them as part of a merger, reorganization or sale of the relevant business, subject to required notice and consumer law. These Terms and applicable additional terms are the complete agreement about the public Service and do not alter a separate written agreement with TruckFix.
